Description of Services and Products Covered
1.) This collection includes up to a 4 hour photo session at the specified day, time and location/s shown above. This includes makeup and wardrobe changes and any time required to change onsite set.
2.) All artistic edits are done in house by Shari DeAngelo will meet the high quality standard of Shari DeAngelo Photography. We don’t limit how many images you will receive in your private gallery. If I believe it’s a quality image that adds to your personal story I am pleased to include it. We reserve the right to pick “best of” of any series of images taken and to not include an image due to it not meeting the quality standard we seek to maintain.
A private (password protected) web gallery will be posted for you to share with family and friends within 2 weeks of your session. This gallery is password protected and link is emailed only to he specified client, unless otherwise agreed upon. It, by default, expires after 30 days. The gallery contains a fully functional shopping cart feature for you and your family and friends to make additional purchases.
3.) A carefully wrapped package will be sent to the address you specify above, as long as it’s in the continental US. We ship via UPS Ground but offer expedited shipping for an additional fee. When the item is shipped, an automated email will be sent via UPS with tracking information. Using UPS’s website, you can make alternative plans for delivery. We do not require signatures but will not be responsible for items left outside and exposed to the elements, so please take care your beautiful photographs do not get destroyed.
Terms and Conditions of Agreement
The parties agree that Shari DeAngelo Photography (hereby referred to as “Photographer” or “we”) will furnish the above specified services of exclusive professional photographer, for the specified day and times for Client named and addressed above (hereby referred to as “Clients” or “you”).
The Lifestyle | Boudoir Session includes 4 hours of photo session time at the day, time and location specified above. Additional time may be added at a price of $250/hr (billed by full hours only).
All Collections includes color-corrected, artistically edited photos for print and web. Some basic skin retouching may be done on images as a courtesy but are not required under this agreement. Images chosen for prints from the Photographer’s lab are fully retouched at no additional charge. Photographer will make every attempt to make necessary edits to please client, but reserves the right to charge digital processing time at $125/hr for unreasonable or persistent changes or retouching that goes beyond standard portrait requirements (ie. braces or person removal).
Every effort is made to keep digital negatives (*) and processed digital images backed up and safe for many years to come, but can only be guaranteed for 1 year after the date of the wedding.
*A digital negative is a raw image data file. It requires special software to read, correct, and save as a JPG, TIF, PSD, GIF, etc. It is used by most professional photographers as they can maintain more control in the end result than allowing the camera to make these decisions.
Specific Photographs and Liability
The photographer will make every effort to assure Client’s satisfaction and in accordance with accepted industry standards. Any artistic interpretations by the photographer will be deemed acceptable and correct. Due to events outside of the photographer’s control, such as weather, late arrival of subjects, missing persons, etc. which may preclude the creation of some images, the photographer does not guarantee the production of any specific image(s). Photographer assumes no liability for failure to comply with the terms of this Agreement due to events outside of the photographer’s control.
Limitation of Liability
While every reasonable effort will be made to produce and deliver outstanding photographs of the subjects, the Photographer’s entire liability to the Clients for any claim arising from the Photographer’s performance is limited to a refund to the Clients of the amount paid for services. Because of he nature of the work, the Photographer cannot guarantee delivery of any specifically requested image(s).
Features Offered
The products and prices listed are current at the time of contract signing. If, for some reason the products are not available, photographer will work with client to find suitable replacements for no additional charges. At any time, prior to final album prints being ordered, substitutions and additions may be made. For the client’s convenience and for that of their family and friends, Shari DeAngelo Photography makes prints, books and other products available for purchase via client’s password protected web pages. Client has full discretion over who may view these pages by sending out guest passes and passwords and each visitor may individually purchase prints. The studio ships these orders directly to the purchaser. The Web Gallery will remain available to anyone with login information for a minimum of 30 days after being published, unless otherwise agreed upon.
Copyright and Reproductions
It is agreed that Shari DeAngelo Photography shall own the copyright to all images created through this contract. Shari DeAngelo Photography, LLC shall have the exclusive right to make reproductions for the Client/s or for the photographers’ portfolios, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, for display within or on the outside of the photographers’ studio, including the World Wide Web. Unauthorized copying or use of the Photographer’s images is an infringement of Federal Copyright Law and a violation of this contract. Unless expressly provided in an addendum this contract does not provide the Client/s with any ownership of or rights to use the negatives or digital image files created under this contract.
Storage of original files
We make every effort to backup files and store them indefinitely, but cannot make guarantees beyond 1 year after your event date.
Retainer Payments and Cancellation
Once the studio reserves a date/time for the Client/s, it ceases to sell its services for this date/time to others. If the event is cancelled or postponed, the Studio suffers a loss. Therefore, RETAINERS ARE NOT REFUNDABLE UNDER ANY CIRCUMSTANCES. If the studio is able to re-book a date/time for which it has received a cancellation or postponement, it may, at its sole discretion, provide a Studio Credit to the Client/s for what, in the Studio’s sole judgment, is a reasonable portion of any payments made by the Client/s. Payment in full is required prior to any work being performed. Any failure of scheduled payments may, at the discretion of Studio, void contract and/or put a hold on any services or products from being delivered.
Cancellation must be made in writing, signed by the contracted party, and sent via Certified Mail by the United States Post Office. If Client fails to supply written cancellation as specified before the session date or cancels within 14 days of the date date, Client shall be required to pay the full balance due.
Photographer cannot guarantee dates and a new agreement may be required if booking cannot be confirmed within 5 days of being sent the link to this form. After that date there may be a price increase and a new agreement will be required.
Checks should be made out to Shari DeAngelo Photography and delivered to 340 Marne Ave., Haddonfield, NJ 08033 no later than due date. We accept credit card payments via the PayPal system. Our payment address is shari@sharideangelo.com
Agreement
This is a binding agreement, which incorporates the entire understanding of the parties, and any modifications must be in writing, signed by both parties, and physically attached to the original agreement. The laws of the State of New Jersey shall govern this contract, and any resulting arbitration shall take place within Camden County, NJ. Client assumes responsibility for all collection costs and legal fees incurred by Photographer should enforcement of this contract become necessary.
In the event that any part of this Agreement is found to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. Any failure by one or both parties to enforce a provision of this Agreement shall not constitute a waiver of any other portion or provision of this agreement.
The parties have read this Agreement in full, agree to all its terms, and acknowledge receipt of a complete copy of the Agreement signed by both parties. By checking this box you agree to the terms and conditions of this agreement.
